Title II Accessibility Compliance Deadline Extended

Have you heard that the Title II Accessibility Deadline has been extended? The Department of Justice issued an Interim Final Rule on April 16, 2026 to extend the compliance deadlines. 

The new deadlines for public entities are:

  • Populations of 50,000 or more: April 26, 2027

  • Populations of less than 50,000: April 26, 2028

What Happened? 

According to the IFR, the DOJ received feedback from public entities, educational organizations, and federal offices, including the SBA’s Office of Advocacy, that applicable entities were encountering challenges while trying to meet the compliance requirements, including:

  • Limited staff and lack of technical expertise

  • Financial constraints

  • Confusion about compliance requirements

The DOJ also acknowledged that accessibility remediation efforts still require significant manual review and that automation tools alone have not addressed remediation needs as effectively as originally anticipated. The DOJ stated that the extension would allow organizations to focus resources on accessibility efforts and remediation planning rather than legal and administrative responses to compliance challenges.

What does this mean for your EDO? 

You have an additional year to work towards compliance before the updated compliance deadline takes effect, but you shouldn’t let this extension delay compliance progress. Organizations may still face accessibility-related complaints or litigation risk under existing ADA obligations.

Documented accessibility efforts can help demonstrate that your organization is taking accessibility seriously.

What should you do? 

1. Take Action Now – Don’t Wait. 

Waiting until the last few months could create additional operational and remediation challenges. Manual remediation (particularly within PDFs, downloadable files, embedded tools and complex content) may still be needed even if you’ve installed automated tools or used automated services. 

2. Create a Plan. 

Start simple. Create a plan that will help you work toward compliance by the new deadline. 

3. Prioritize Remediation. 

Some issues will be simple to correct, like adding the proper tag to an image. Some will be high-impact and more complex. Focus on these first. 

4. Start creating accessibility-minded content now. 

Start creating accessibility-minded content now, and establish best practices for website and content publishing and updates moving forward.
